(8) If the heres is directed to transfer not the whole but ¾ of the inheritance, the transferree has to satisfy the legatees, but deducts and retains for himself ¼ of their legacies, as he would under the circumstances supposed in (3).
According to Vangerow, § 509, and more recent writers, however, the Interdict was confined to the purpose of obtaining Possession of the corporeal things belonging to the inheritance, separate fictitious actions being employed on account of other rights and liabilities, for the equitable or praetorian successor could not sue or be sued by direct actions.
