Bṛhaspati Smṛti
Persons who guarantee another's appearance, honesty, payment, or delivery in a debt or legal matter.
For appearance, for confidence, for payment, and likewise for the delivery of the debtor's property, the surety is seen in the treatises by the wise to be of four kinds.
A surety for appearance must produce the person at the specified place and time;
In case of the death of the person to be produced, another surety for the person to be produced must be furnished.
Kātyāyana Smṛti
A guarantor appointed for appearance, payment, trust, or oath, whose liabilities and rights of recovery are extensively detailed.
For payment, appearance, in disputes, for trust, and for an oath, one should have a guarantor appointed, as is appropriate in each case.
The first two (sureties for appearance and trust), if they fail, are liable to pay the amount reported at that time.
