The tort of causing harm through failure to take due care.
The rule as to burden of proof in cases of negligence was held not to apply to a case where the defendant had maintained a dangerous nuisance, and the plaintiff, a young child, had suffered such harm as that nuisance (a row of spikes on the top of a low wall) was likely to cause.
Causing harm by negligence is a tort.
There is a point, though not an easily defined one, where such shortcoming gives rise even to criminal liability, as in the case of manslaughter by negligence.
